Navigating the world of special education is a daunting experience. This is even more true when your child struggles with challenging behaviors in school, of which are often related to a disability. It can be overwhelming. Schools may informally remove your child from class, call you to pick them up early due to maladaptive behavior. If not documented these are considered informal removals. A student with a disability has protections under the Individuals with Disabilities Education Act and Section 504 of the Rehabilitation Act.
Maladaptive behavior can result in a loss of educational time, poor peer relationships, school avoidance and can have emotional ramifications for any student, which can result in a denial of a Free and Appropriate Public Education (FAPE). FAPE is the cornerstone of both laws. Because of this, there are specific requirements schools must follow when a student exhibits maladaptive behavior.
